Please read these Terms of Use carefully before using OffMemory ("the App"). By downloading, installing, accessing, or using the App, you agree to be bound by these terms. If you do not agree, do not use the App.

1. License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use the App on Apple devices that you own or control, solely for your personal, non-commercial purposes.

2. No Account Required

The App does not require you to create an account, provide an email address, or register a phone number. All data is stored locally on your device. Because there is no account, there is no account deletion process.

3. In-App Purchase

The App offers a single one-time in-app purchase that permanently unlocks unlimited notes and premium features. This is a non-consumable, non-subscription purchase processed entirely by Apple through the App Store. All payment terms, refunds, and billing disputes are subject to Apple's policies. We do not receive or store your payment information.

4. Your Responsibilities

• You are solely responsible for safeguarding your unlock password and security-question answers. We cannot reset or recover them.
• You are responsible for maintaining backups of your notes using the App's export feature. We do not store copies of your data.
• You agree not to use the App for any illegal, harmful, or unauthorized purpose.
• You may not reverse-engineer, decompile, disassemble, modify, or create derivative works of the App, except as permitted by applicable law.

5. Intellectual Property

All content, design, graphics, logos, code, and other materials in the App are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or commercially exploit any part of the App without our prior written consent.

6. Data and Privacy

Your use of the App is also governed by our Privacy Policy. The App does not collect personal data and operates without network connectivity, except for Apple's StoreKit used for the one-time purchase.

7. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, secure, or error-free.

Because your notes are encrypted and stored only on your device, you acknowledge that forgetting your password and security answers will result in permanent, irreversible loss of access to your data.

8. Limitation of Liability

To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or use, arising out of or in connection with your use of the App, even if we have been advised of the possibility of such damages.

9. Termination

We may suspend or terminate your license to use the App at any time without notice if you violate these Terms. You may terminate your use at any time by uninstalling the App. Upon termination, all local data remains on your device until you delete it.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the People's Republic of China, without regard to conflict-of-law principles.

11. Changes to These Terms

We may update these Terms from time to time. The revised version will be included in the next App update and posted on our website, with the "Last updated" date revised accordingly. Continued use of the App after changes constitutes acceptance.
